When you're considering firing someone, here are some factors to consider

An exit interview form should contain questions that will allow you to collect objective information about your small company environment. I must inform you that because of your misbehavior in the form of (state here either company theft or misuse of firm property), your employment with (company name) will be dismissed immediately. If an employee receives a dismissal memorandum, it should not be a shock, but rather should give the jobholder an opportunity to nod in understanding. Again use third-party eyewitnesses, like Human resources Employees, to work on your behalf. After laying off personnel, immediately turn your attention to the emotional desires of the remaining personnel. If the worker is in violation of any of the infractions that result in dismissal, you're dealing with layoff for cause. As well, there should be a place on the form for the jobholder to sign that they agreed to the warning and to future actions that will be taken.

Workers want to know why you're sacking them and juries agree the workforce have a right to know. After 3 warnings, you can fire. Lastly, you must address how you will handle final pay will and describe any special severance packages. Give them every opportunity to upgrade. If you need the jobholder to stay, it's better to say, "You can leave if you want, but you may be subject to discipline and layoff.". Keep in mind that if there is a legal action, a court can use your as evidence against you and the company. If counseling and warnings fail, the sole proprietor or Personnel director must fire the insubordinate individual and hire a better individual for the job. If you do, you'll have greater success in protecting the small company from illegal layoff lawsuits.
